This User Agreement (hereinafter referred to as the “Agreement”) sets out the terms and conditions that govern your use of Cosmix (including all its features, functions, content, and services provided through the App, collectively referred to as the “Service”). By downloading, installing, or using the Service, you (hereinafter referred to as the “User”) confirm that you have read, understood, and fully agreed to all the terms and conditions of this Agreement, as well as Cosmix’s Privacy Policy (which is an integral part of this Agreement and has the same effect as this Agreement). If you do not agree to any part of this Agreement, you must immediately stop downloading, installing, and using the Service. This Agreement applies to all Users who access or use the Service, and your continued use of the Service constitutes your ongoing acceptance of this Agreement and any subsequent updates.
Cosmix is committed to protecting your privacy and providing you with a safe, convenient, and high-quality Service. This Agreement is formulated to clarify the rights and obligations between you and Cosmix, standardize User behavior, and ensure a positive and respectful user experience for all. We have avoided complex jargon and hidden clauses, making this Agreement clear, transparent, and easy to understand. Please read this Agreement carefully before using the Service, as it contains important information about your rights and responsibilities.
By downloading, installing, or using the Service, you confirm that: (1) You are at least 18 years of age and have the full capacity to enter into and comply with this Agreement; (2) You have read, understood, and fully agreed to all the terms and conditions of this Agreement, as well as Cosmix’s Privacy Policy; (3) You will comply with all applicable rules, guidelines, and requirements when using the Service; (4) You will use the Service only for legitimate, non-harmful purposes, in line with public morality and good customs. If you are under 18 years of age, you are not permitted to download, install, or use the Service, as we prioritize the privacy and safety of minors above all else.
Cosmix reserves the right to update or revise this Agreement from time to time to reflect improvements to the Service, changes in user needs, or feedback from Users. Any updates or revisions will be posted within the App, and we will notify you through a clear, unobtrusive notification the next time you open the App. Your continued use of the Service after the update or revision takes effect constitutes your acceptance of the revised Agreement. We encourage you to review this Agreement periodically to stay informed of any changes. We will never make changes that reduce your rights or increase your obligations without your knowledge, and all updates will be consistent with our commitment to protecting your privacy and providing high-quality service.
Cosmix provides a professional AI image-to-image COS costume change Service, which includes but is not limited to the following core functions: (1) Providing a variety of COS-style costumes, covering anime, game characters, and other popular styles, with a dreamy purple and cyan two-dimensional visual style; (2) Allowing Users to upload portrait photos to quickly generate COS works, with intelligent AI algorithms that accurately fit facial contours and body shapes, ensuring natural integration of costumes and delicate details; (3) Supporting quick switching between multiple COS styles, allowing Users to try different looks with one click; (4) Supporting HD saving of generated COS works, local management of saved works, and one-click sharing to social media platforms or other third-party apps; (5) Providing a simple and user-friendly interface, with easy-to-operate functions that require no professional retouching skills, suitable for all types of Users.
Cosmix is committed to continuously improving the Service, optimizing functions, and enhancing the user experience. We may add, modify, or suspend some or all of the Service functions from time to time, depending on technical upgrades, market demand, or other reasonable reasons. We will make reasonable efforts to notify Users of any significant changes to the Service, but we reserve the right to make adjustments without prior notice if necessary (such as emergency technical maintenance). We will never suspend or terminate the Service without just cause, and any suspension or termination will be done in a way that minimizes impact on Users.
The Service is provided free of charge for Users to create and generate COS works. Cosmix does not charge any fees for the core functions of the Service. However, we reserve the right to launch paid additional services in the future (such as exclusive premium COS costume collections), and any paid services will be clearly marked with pricing and terms before you choose to use them. Your use of any paid services will be subject to additional terms and conditions, which will be provided to you separately.
During your use of the Service, you are entitled to the following rights, subject to compliance with this Agreement and relevant rules: (1) The right to use all core functions of the Service free of charge, including uploading portrait photos for COS generation, switching COS styles, saving HD works, managing local works, and sharing works with one click; (2) The right to privacy protection, as stipulated in Cosmix’s Privacy Policy—Cosmix will never collect, store, process, or share your facial information, portrait photos, generated COS works, or any other personal data; (3) The right to provide feedback on the Service, including suggestions for function optimization, bug reports, and other opinions, and Cosmix will carefully review and consider your feedback; (4) The right to control your own generated and saved COS works, including deleting, sharing, or keeping them private, with full exclusive control over such works; (5) The right to refuse any unnecessary permissions requested by the App, and to revoke permissions at any time through your device’s settings, without affecting your ability to use non-related functions of the Service; (6) The right to use the Service completely anonymously, without the need to create an account or provide any personal information.
You have the right to stop using the Service at any time by uninstalling the App. Uninstalling the App will terminate your use of the Service, but it will not affect any rights or obligations that have already arisen before uninstallation. Cosmix will not collect any data about your uninstallation or the reason for uninstallation, in line with our zero-data-collection principle.
When using the Service, you must comply with the following obligations to ensure the normal operation of the Service and the safety and rights of other Users: (1) Comply with this Agreement, Cosmix’s Privacy Policy, and all applicable rules and guidelines of the Service; (2) Use the Service only for legitimate purposes, and not use the Service to engage in any illegal, harmful, or inappropriate activities; (3) Ensure that any portrait photos you upload are your own or that you have obtained explicit, written consent from the person in the photo—you shall not upload photos of others without their consent, which may invade others’ privacy; (4) Do not upload, generate, or share any inappropriate, harmful, or offensive content through the Service, including but not limited to pornographic, sexually explicit, violent, bloody, discriminatory, harassing, or illegal content; (5) Do not tamper with, modify, or reverse-engineer the App, or use any third-party software, plug-ins, or tools to interfere with the normal operation of the Service or obtain improper access to the Service; (6) Do not use the Service to infringe on the intellectual property rights, privacy rights, or other legitimate rights and interests of Cosmix or any third party; (7) Do not use the Service in a way that overloads, crashes, or damages Cosmix’s servers or technical systems; (8) Ensure that the device you use to access the Service is safe and free of viruses, malware, or other harmful software that may affect the Service or other Users; (9) Respect the rights and interests of other Users, and do not harass, slander, or infringe on the legitimate rights and interests of other Users through the Service; (10) Cooperate with Cosmix’s reasonable requests to maintain the normal operation of the Service, such as providing feedback on bugs or technical issues.
You are solely responsible for all activities conducted through your device when using the Service, including any content you upload, generate, or share, and any consequences arising from your non-compliance with this Agreement. You agree to bear all losses, liabilities, and costs incurred by Cosmix or any third party due to your violation of this Agreement or improper use of the Service. This includes but is not limited to losses caused by uploading inappropriate content, infringing on others’ rights, or interfering with the normal operation of the Service.
Protecting your privacy is one of Cosmix’s core commitments, and this commitment is fully reflected in Cosmix’s Privacy Policy, which is an integral part of this Agreement. By agreeing to this Agreement, you also agree to the terms of the Privacy Policy.
To reiterate our key privacy commitments: (1) Cosmix does not require you to create an account, log in, or provide any personal information to use the Service—you can use the Service completely anonymously; (2) Cosmix never collects, stores, processes, or retains any of your facial information, portrait photos, or personal images. Any portrait photo you upload is only used temporarily to generate the COS effect and is immediately deleted after use, with no backups, archives, or hidden copies; (3) Cosmix never collects any other personal or sensitive data, including but not limited to your device information, IP address, location, browsing history, or usage patterns; (4) Cosmix never sells, rents, trades, or shares any of your private information with third parties, and any third-party services used for essential functionality are contractually obligated to protect your privacy; (5) Any generated COS works you save are stored only locally on your device, and Cosmix has no access to or control over such works.
Cosmix will take all reasonable technical and administrative measures to protect your privacy and ensure the security of any temporary data processed by the Service. This includes industry-standard encryption protocols, secure server hosting, regular security audits, and strict internal confidentiality agreements for staff. We will never compromise your privacy for any reason, and we will continuously improve our privacy protections to adapt to new technical and security challenges.
All intellectual property rights related to the Service, including but not limited to the App’s software, code, design, text, images, logos, trademarks, COS costume designs, and any other content provided through the Service, are owned by Cosmix or its authorized licensors. These intellectual property rights are protected by applicable rules, and no one may use, copy, modify, distribute, transmit, display, reproduce, or exploit them without the prior written permission of Cosmix.
You acknowledge and agree that: (1) You have no right to claim any intellectual property rights over the Service or any content provided by the Service; (2) You may only use the content provided by the Service for personal, non-commercial purposes (i.e., creating COS works for your own use, sharing with friends, or short video creation), and you may not use it for commercial purposes, such as selling, promoting, or distributing the content without Cosmix’s permission; (3) Any COS works you generate using the Service are your own creative content, and you retain the intellectual property rights to such works, but you agree not to use them in a way that infringes on Cosmix’s intellectual property rights or violates this Agreement; (4) You may not use the Service to generate content that infringes on the intellectual property rights of any third party, and you shall bear all liabilities arising from such infringement.
In addition to the obligations set out in Section 4, you are strictly prohibited from engaging in any of the following conduct when using the Service. Cosmix reserves the right to take appropriate measures (including but not limited to warning, restricting access, or terminating the Service) against any User who engages in such conduct, and to pursue your liability for any losses incurred:
(1) Uploading, generating, or sharing pornographic, sexually explicit, or vulgar content—including but not limited to portrait photos, generated COS works, or any other content that depicts nudity, sexual acts, or is designed to be sexually suggestive; (2) Uploading, generating, or sharing violent, bloody, or harmful content—including but not limited to content that depicts violence, bloodshed, cruelty, self-harm, suicide, or dangerous behavior that could encourage harm to oneself or others; (3) Uploading, generating, or sharing harassing, abusive, discriminatory, or hate speech content—including content that promotes discrimination based on race, gender, religion, age, sexual orientation, or any other characteristic, or content that harasses, threatens, or insults others; (4) Uploading or using photos of others without their explicit, written consent, or generating COS works using photos of strangers, which invades others’ privacy; (5) Using the Service to engage in illegal activities, including but not limited to fraud, theft, or the spread of illegal information; (6) Tampering with, modifying, reverse-engineering, or decompiling the App, or using any third-party software, plug-ins, or tools to interfere with the normal operation of the Service; (7) Using the Service to infringe on the intellectual property rights, privacy rights, or other legitimate rights and interests of Cosmix or any third party; (8) Spamming, phishing, or engaging in other activities that disrupt the Service or harass other Users; (9) Providing false information or impersonating others to use the Service; (10) Any other conduct that violates this Agreement, public morality, or applicable rules.
While Cosmix is committed to providing a stable, safe, and high-quality Service, we make no warranties or guarantees regarding the following matters: (1) The Service will be uninterrupted, error-free, or available at all times—technical issues, network problems, or other unforeseen circumstances may cause temporary interruptions to the Service; (2) The generated COS effect will be 100% consistent with your expectations—due to differences in device screens, photo quality, lighting conditions, and individual facial features, there may be slight differences between the generated effect and your expected effect; (3) The accuracy, completeness, or applicability of any content provided through the Service—including but not limited to COS costume styles, colors, and details; (4) The safety of your device or data when using the Service—you are responsible for ensuring the security of your device and taking appropriate measures to protect your saved COS works and other data.
Cosmix will not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use or inability to use the Service, including but not limited to damages to your device, loss of data, or any other losses, even if Cosmix has been notified of the possibility of such damages. This includes but is not limited to losses caused by: (1) Technical failures, network interruptions, or system errors; (2) Your non-compliance with this Agreement or improper use of the Service; (3) Third-party interference or attacks on the Service; (4) Force majeure or other circumstances beyond Cosmix’s control.
You agree that you use the Service at your own risk, and Cosmix will not be liable for any losses or damages arising from your use of the Service, except for losses caused by Cosmix’s intentional or gross negligence. This disclaimer does not affect any rights you may have under applicable rules that cannot be excluded or limited.
You may terminate your use of the Service at any time by uninstalling the App. Cosmix may terminate or suspend your access to the Service in the following circumstances, without prior notice: (1) You violate any terms of this Agreement or Cosmix’s Privacy Policy, and fail to correct the violation within a reasonable time after being notified; (2) You engage in prohibited conduct that endangers the safety of the Service or the rights and interests of other Users; (3) Your device is found to have viruses, malware, or other harmful software that may affect the Service; (4) We need to suspend or terminate the Service due to technical upgrades, legal requirements, or other reasonable reasons.
Upon termination of the Service, all rights and obligations you have under this Agreement will cease, except for any rights or obligations that should survive termination (including but not limited to intellectual property rights, privacy protection obligations, and liability for past violations). Cosmix will not be liable for any losses you incur due to the termination of the Service, except for losses caused by Cosmix’s intentional or gross negligence. If the Service is terminated due to your violation of this Agreement, you will still be liable for any losses incurred by Cosmix or third parties as a result of your violation.
